By accessing or using earthvibrance.com (the “Website”), placing a retail or bulk order for factory-made apparel, creating an account, or requesting custom branding services, you agree to be bound by these Terms of Service (the “Terms”). Please read these Terms carefully—if you do not agree, you may not use the Website or purchase products from earthvibrance.com.

1. Eligibility

To use our services, you must be at least 18 years old or have the legal consent of a parent or guardian. For bulk orders, you represent and warrant that you have the authority to bind your business, organization, or school to these Terms (if ordering on their behalf). You also warrant that all information you provide (e.g., shipping, billing, business details) is accurate, complete, and up-to-date. For custom-branded apparel, you warrant that you have the right to use any logos, artwork, or text you submit—this includes obtaining all necessary copyright, trademark, or permission from third parties for proprietary content. You may not use our services to order apparel with offensive, illegal, or infringing content (as defined in Section 6 below).

2. Account Responsibility

When creating an account, you are responsible for choosing a secure password and maintaining the confidentiality of your account information (username, password, email). You agree to notify us immediately at non-reply@only1services.com if you suspect unauthorized access to your account (e.g., unauthorized orders, bulk order requests, or account changes). earthvibrance.com is not liable for any loss or damage caused by your failure to protect your account.
You are responsible for all activities conducted through your account, including retail/bulk orders placed, charges incurred, custom branding requests, and interactions with customer support. We reserve the right to suspend or terminate your account at any time (without prior notice) if we suspect fraudulent activity (especially for large bulk orders), violation of these Terms, abusive behavior (e.g., harassing staff, submitting offensive custom designs), or unauthorized use of copyrighted content.

3. Product Information & Availability

We strive to provide accurate product information (e.g., descriptions, sizes, fabrics, color details, and custom branding options) for our factory-made apparel. However, we do not warrant that product information is error-free, complete, or current. This includes minor variations in fabric color (due to factory production batches or monitor settings), slight differences in fit (for different body types), and variations between product images and actual items (photos are taken of real factory-made apparel, but minor differences may occur). Our sizing guides are provided as a reference—we recommend ordering a sample (available for bulk customers) before placing large bulk orders to ensure fit.
We reserve the right to discontinue apparel styles, limit quantities (especially for factory clearance items), adjust prices, or modify custom branding options at any time without notice. Product availability is subject to change—if an item you ordered becomes unavailable after purchase, we will notify you via email and offer a full refund or alternative product (with your consent). In the event of a pricing error (retail or bulk), we reserve the right to cancel your order and issue a full refund, even if the order has been confirmed.

4. Custom Branding & Bulk Order Terms

For custom-branded bulk orders (screen printing, embroidery, etc.):
  • We provide a digital proof of your custom design (logo placement, color, size) for your review and approval before production begins. By approving the proof, you confirm that the design meets your expectations—earthvibrance.com is not liable for design errors or discrepancies present in the approved proof.
  • Production setup fees may apply for custom branding (disclosed at checkout or in your bulk order quote). Setup fees are non-refundable once production begins (even if you cancel the order).
  • Minimum order quantities (MOQs) apply to custom-branded apparel (typically 10+ items per design). We may waive MOQs for small businesses or organizations at our discretion—contact non-reply@only1services.com to inquire.
  • Bulk order cancellations: (a) Non-branded bulk orders: May be canceled within 24 hours of placement for a full refund. Cancellations after 24 hours are subject to a 20% restocking fee (to cover factory production costs). (b) Custom-branded bulk orders: May be canceled within 48 hours of proof approval for a full refund (excluding setup fees). Cancellations after production begins are non-refundable.

5. Order Placement & Acceptance

Placing an order on earthvibrance.com constitutes an offer to purchase the selected apparel. We reserve the right to accept or reject your order for any reason, including but not limited to: product unavailability, pricing errors, suspicious/fraudulent activity (especially for large bulk orders), incomplete order information, violation of these Terms, or submission of unauthorized/offensive custom designs. Order confirmation (email) does not constitute acceptance—we will send a Shipment Confirmation email (retail) or Production Confirmation email (bulk) once your order is processed, which signifies official acceptance.
If we reject your order (e.g., due to prohibited content), we will notify you via email and issue a full refund (if payment was processed).

6. Prohibited Content

You may not submit or use any content for custom-branded apparel that:
  • Infringes on the copyright, trademark, patent, or other intellectual property rights of any third party (e.g., unlicensed logos, artwork, or text from brands, artists, or media).
  • Is offensive, discriminatory, or harassing (e.g., content promoting racism, sexism, homophobia, hate speech, violence, or discrimination based on religion, disability, or gender).
  • Is illegal, fraudulent, or promotes illegal activity (e.g., content promoting theft, violence, illegal substances, or counterfeiting).
  • Contains personal information of others without their explicit consent (e.g., full names, addresses, phone numbers, or email addresses).
  • Is defamatory, libelous, or misleading (e.g., false claims about individuals, organizations, or products).
earthvibrance.com reserves the right to reject any order containing prohibited content, cancel associated orders (retail or bulk), and suspend/terminate your account without refund if you violate this section. You agree to indemnify earthvibrance.com against any claims, damages, or legal fees arising from your submission of prohibited content.

7. Payment Terms

We accept the following payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, and (for bulk orders) bank transfers or purchase orders (POs) (approved businesses only). For bulk orders over $500, we may require a 50% deposit upfront, with the remaining balance due before shipment (disclosed in your bulk order quote).
By providing payment information, you represent and warrant that you are authorized to use the payment method (e.g., you are the cardholder or have business authorization). We charge your payment method at the time of order placement (or deposit for bulk orders)—if payment is declined, your order will not be processed. We do not store full payment details—all payment processing is handled by secure third-party providers compliant with PCI DSS.

8. Intellectual Property

All content on earthvibrance.com (including logos, trademarks, product designs, website text, graphics, and software) is the intellectual property of earthvibrance.com or the respective rights holders, protected by U.S. and international copyright laws. You may not copy, reproduce, distribute, modify, or use any content for commercial purposes without our prior written permission.
For custom designs you create using our services: You retain ownership of your original content (e.g., your logo or artwork), but you grant earthvibrance.com a non-exclusive, royalty-free license to use, reproduce, and print your design solely for the purpose of fulfilling your bulk order. We may use anonymized versions of your custom design (without any business/personal information) for marketing purposes (e.g., bulk order case studies) only with your explicit consent.

9. Care & Usage Guidelines

Each piece of factory-made apparel from earthvibrance.com includes care instructions (printed on a tag or listed on the product page). We recommend following these instructions to preserve the quality of the fabric and custom branding (e.g., washing inside out in cold water, using mild detergent, avoiding bleach or fabric softeners, and tumble drying on low heat or air drying). earthvibrance.com is not liable for damage caused by improper care, including fading of prints/embroidery, shrinking of fabric, or damage to the apparel.

10. Limitation of Liability

To the maximum extent permitted by law, earthvibrance.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, business interruption, or loss of brand reputation) arising from your use of the Website, purchase of retail/bulk apparel, custom branding services, or these Terms. Our total liability to you shall not exceed the total amount you paid for the specific item(s) or bulk order in question.
We shall not be liable for delays caused by shipping carriers, weather, factory production delays (for bulk orders), or other events beyond our control. We also shall not be liable for design errors approved by you, natural variations in factory production, or damages caused by improper care of the apparel.

11. Indemnification

You agree to indemnify, defend, and hold harmless earthvibrance.com, its officers, directors, employees, factory staff, and custom branding partners from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from your use of the Website, violation of these Terms, infringement of any third-party rights (e.g., intellectual property violations from custom logos), misuse of our products (e.g., reselling factory-direct apparel as branded goods), or bulk order disputes (e.g., issues with your organization’s end-users).

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to conflict of law principles. Any dispute arising from these Terms, your use of the Website, or a retail/bulk order shall be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association (AAA). The arbitration award shall be final and binding, and judgment may be entered in any court of competent jurisdiction. You waive the right to a jury trial for any disputes under these Terms.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page and post the revised Terms on the Website. Your continued use of the Website or purchase of retail/bulk apparel after the changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically (especially before placing bulk orders).
